This legal position paper looks at the 11 February 2010 decision by the Israeli Supreme Court invalidating article 5 of the Criminal Procedure Law (Detainee Suspected of Security Offense) (Temporary Order) – 2006, which provided that “security” detainees could have their pre-trial detention extended in a hearing held in their absence. This law was almost exclusively applied to Palestinians from the Gaza Strip.
