This law has been employed in the Gaza Strip to indefinitely detain Palestinians without substantive judicial oversight. Initially ratified by the Israeli Knesset in 2002, the law was intended to allow the prolonged detention of Lebanese nationals held as “bargaining chips” after the Israeli Supreme Court declared such practices unlawful. Although all Lebanese detainees were released in 2004, the law remained active. Since 2005, following Israel’s unilateral "disengagement" from Gaza and the termination of military orders in the area, it has been used to detain residents of Gaza.</p> <p> </p> <p>On October 27, amendments to this law were published in the Nevo legal data base, designating two new military camps in Galilee: </p> <p>1. Naftali Military Camp </p> <p>2. Amiad Military Camp</p> <p> </p> <p>In light of the intensified attacks by the Israeli Occupation Forces (IOF) along the southern Lebanese border, there is a credible likelihood that these newly established military camps are intended to hold Lebanese detainees. This concern is further substantiated by the recent killing of a Lebanese detainee last week on October 19th while in IOF custody.Similar to previous statements by the Occupation's Military Police regarding “investigations” into abuses against Palestinian detainees, the occupying authorities have declared their intention to “open an investigation” into this incident. However, historical precedent indicates that over 99% of such “investigations” are consistently dismissed due to alleged “lack of evidence,” thus reinforcing longstanding concerns regarding accountability within the occupation’s military justice system.</p> <p> </p> <p>Addameer has been rigorously documenting the appalling conditions and human rights violations occurring within the Sde Teman and Anatot military camps, established by the occupying state on October 8, 2023. This is a result of an order issued by the Israeli Minister, Yoav Galant, designating Palestinian detainees from the Gaza Strip as "unlawful combatants" under the Israeli Unlawful Combatants Law of 2002. The order also mandates the detention of Gaza detainees specifically within the “Sde Teman” military camp, as stipulated in sections 3(a-b).</p> <p> </p> <p>Although the Occupation’s High Court has issued an order for the closure of the Sde Teman camp, the occupying forces continue to detain Palestinians from Gaza within its make-shift cages that are described by the detainees as “chicken coops.” Amid recent large-scale arrest campaigns in Jabalia within the Gaza Strip, a substantial number of detainees have likely been transferred to the camp over the past two weeks.Through documentation, detainees are held in deplorable conditions, enduring severe physical and psychological abuse, strip searches, systematic starvation policies, and pervasive medical neglect. These brutal practices persist within the camp’s cells and cages, amounting to an alarming pattern of inhumane and degrading treatment.</p> <p>The Occupation continues to operate with impunity, facing no accountability from the international community. Without immediate intervention, Lebanese detainees risk enduring the same inhumane torture and severe human rights abuses reported within the Occupation's detention centers. Urgent international action is required to prohibit the establishment of the new military camps, Naftali and Amiad, and prevent them from being used for any form of detention. Furthermore, comprehensive intervention is essential to demand the complete dismantlement of all detention facilities operated by the Occupation, particularly in light of the International Court of Justice's (ICJ) ruling, which has reaffirmed the unlawful nature of the occupation. This statistic includes women arrested from the 1948 occupied territories, as well as arrests of women from Gaza who were detained in the West Bank. However, this figure does not include the number of women arrested from Gaza, which is estimated to be in the dozens.</p> <p>- Children: The number of arrests among children in the West Bank has reached at least 740.</p> <p>- Journalists: The number of arrests among journalists since the beginning of the genocidal war has reached 108. Of these, 58 remain in custody, including 6 female journalists, and at least 22 journalists from Gaza whose identities have been confirmed. Among the journalists, 16 are held under administrative detention.</p> <p> </p> <p>• More than (9000) orders of administrative detention have been issued since October 7, ranging between new orders and renewals, including orders against children and women. </p> <p> </p> <p>• Accompanying the ongoing arrest campaigns are escalating crimes and violations, including severe beatings and assaults, threats against detainees and their families, as well as widespread destruction and vandalism of citizens' homes, confiscation of vehicles, money, and gold jewelry. Additionally, there has been extensive destruction targeting infrastructure, particularly in the camps of Tulkarm and Jenin, the demolition of homes belonging to the families of prisoners, and the use of family members as hostages, alongside the use of detainees as human shields.</p> <p> </p> <p> </p> <p>• Statistics since the beginning of the genocide includes all those who have been detained from their homes, at military checkpoints, those who were forced to surrender under pressure, and those who were held as hostages.</p> <p>- It should be noted that the data related to cases of arrests in the West Bank include those whom the occupation has kept in custody, as well as those who have been released later.</p> <p> </p> <p>• In addition to these arrest campaigns, the occupying forces have carried out field executions, including individuals from the families of detainees.</p> <p> </p> <p>• The highest number of arrests has been recorded in the governorates of Jerusalem and Hebron.</p> <p> </p> <p> </p> <p>• At least 40 prisoners whose identities have been revealed and announced have been martyred in the occupation prisons since October 7. In addition, dozens of detainees from Gaza have been martyred in the prisons and camps, with the occupation not disclosing their identities or the circumstances of their martyrdom, along with many others who have been subjected to field executions.</p> <p> </p> <p>• It is worth mentioning that 38 of the prisoners who have been martyred and announced since the beginning of the war of extermination have had their bodies withheld. They are among 49 martyrs whose bodies the occupation continues to hold and whose identities have been announced.</p> <p> </p> <p> </p> <p>• These data do not include the number of arrest cases from Gaza, noting that the occupation has acknowledged that it has detained more than 4,500 citizens from Gaza, with hundreds of them released. It is also important to mention that the occupation has arrested hundreds of Gaza workers in the West Bank, in addition to citizens from Gaza who were present in the West Bank for medical treatment.</p> <p> </p> <p>Total current number of detainees held in Israeli prisons until October 2024:</p> <p>- The number of prisoners and detainees in the occupation's prisons exceeds 10,100 as of the beginning of October 2024. The number of administrative detainees is 3,398. Additionally, the occupation's prison administration has classified 1,618 detainees from Gaza as "unlawful combatants." It should be noted that this data does not include all detainees from Gaza, particularly those in the camps run by the occupation army.</p> <p>- The number of female prisoners whose identities are known is 95, among them three from Gaza who are held in Damon Prison. The number of female administrative detainees is 26. The genocidal war is an extension of long decades in which the occupation practiced systematic crimes, such as torture and medical crimes, that led to the martyrdom of hundreds of detainees over the years of occupation.</p> <p>Since the beginning of the war, dozens of prisoners and detainees from all Palestinian areas have been martyred in the prisons and camps of the occupation. The issue of martyred detainees from Gaza has posed the greatest challenge for human rights organizations, in light of the crime of enforced disappearance committed against them and the occupation's refusal to disclose their identities or even the circumstances of their martyrdom.</p> <p>Over the past period, prisoner support and human rights organizations have followed this case, which has been accompanied by horrific crimes, including torture, medical crimes, rape, and sexual assaults at various levels. These crimes were reflected in the testimonies of released prisoners and detainees, as well as those still held in the prisons and camps of the occupation.</p> <p>Despite certain legal amendments made by the occupation,the prisoner support organizations have managed to uncover the fate of hundreds of Gaza detainees and conduct limited visits to some prisons and camps. However, hundreds of detainees remain subjected to enforced disappearance.</p> <p>Based on the monitoring by the Palestinian prisoner support and human rights organizations, as well as human rights institutions in the occupied territories, we emphasize several important findings:</p> <p>First: We affirm that, to this day, there is no clear data on the exact number of Gaza detainees among the total number of prisoners in the occupation’s prisons, apart from what was announced by the Israeli Prison Service at the beginning of October, which amounted to 1,618 individuals classified as "unlawful combatants." However, based on our monitoring, the number of Gaza detainees is estimated to be in the thousands.</p> <p>Second: Regarding the number of martyrs, we clarify the following:</p> <p>The total number of martyred prisoners and detainees in the Israeli occupation’s prisons and camps, whose identities are known, since the start of the war of genocide has reached (40). Among them, (14) are from the West Bank, including Jerusalem, (2) from the 1948 occupied territories, and (24)from Gaza. It is worth noting that the prisoner institutions had previously announced the names of (25) martyred prisoners from various regions, and today we are announcing (15) additional names of martyrs from Gaza. These were confirmed by responses from the occupation army, indicating that they were martyred in the prisons and camps, and their families were informed, with the exception of Dr. Iyad Al-Rantisi, whose martyrdom was reported by the Hebrew newspaper Haaretz. However, we have yet to receive a clear response from the occupation army regarding the circumstances of his martyrdom.</p> <p>Third: We affirm that the reported figure of (24) martyrs among the Gaza detainees is not a definitive number of the martyrs within this group, as some sources from the occupation’s media and Israeli human rights organizations estimate the number to be in the dozens. However, we clarify that the information we have released pertains only to those whose names and details we have obtained, and for whom there was a response from the occupation army regarding the date of their arrest and martyrdom. This information has been confirmed by several human rights organizations, including The Ministry of Detainees and Ex-Detainees Affairs, the Palestinian Prisoner’s Club,  Addameer Prisoner Suport and Human Rights organization, the Addameer organization in Gaza, the Al-Mezan Center, the Israeli organization Hamoked, and the Israeli organization B’Tselem. Additional information came from other Palestinian sources that aligned with the testimonies of prisoners released later.</p> <p>Fourth: We also affirm that the occupation army's response regarding the martyrdom of detainees from Gaza remains based on a foundation of doubt, as there is no evidence available to the organizations regarding their martyrdom, especially considering that the occupation continues to withhold their bodies. We note that some of the responses we received from the occupation army indicated that there is an ongoing investigation by the occupation. Through this, the occupation seeks to avoid any international accountability by claiming the existence of internal legal follow-up. However, experience has shown that these investigations are merely formalities and ineffective, as they do not lead to any form of accountability. Today, more than ever, the judicial system of the occupation confirms that it is merely a tool in the hands of the political level of the occupation and part of a process to entrench the crime.</p> <p>Fifth: Despite the conclusion and conviction that experience has solidified regarding the formality of these investigations, we, as institutions, will continue the legal pursuit on behalf of the families of the martyrs whose identities are known. This is to assert their right to participate in the investigation into the circumstances of their martyrdom, which the occupation claims to have initiated in some cases. Once again, this approach is not aimed at expecting any form of "justice" from an occupation that has reached unprecedented levels of crimes. Rather, it is about affirming the family’s right to legal recourse and following up on the issue of demanding the return of their martyred child’s body. Occupation forces raided his home after midnight on August 21, 2024, after blowing up the doors. They searched the house, assaulted him with beatings, and restrained him before holding him alone in one of the rooms. He was then transferred to Ofer Prison, where he remains detained till today.</p> <p>Ammar is one of more than 250 children inside the occupation's prisons and one of forty children subjected to arbitrary administrative detention. He is the youngest among them. For years, the occupation authorities have used arbitrary administrative detention against all Palestinian society as a tool of repression and control, with even children not spared from this oppressive policy. The occupation issues administrative detention orders against children without filing charges against them, claiming the existence of secret files. This policy steals their childhood, placing them in cells that kill all meaning of life and childhood, depriving them of their right to education and their right to a safe life.</p> <p>The occupation authorities have intensified the use of arbitrary administrative detention against the Palestinian people since the early days of the ongoing occupation's aggression and genocidal war, as part of continuous arrest campaigns. Today, more than 3,500 administrative detainees are held in the occupation's prisons, as part of a policy of revenge and collective punishment practiced against the Palestinian people.</p> <p>Palestinian children are not enjoying the rights guaranteed to them under all international agreements and treaties, particularly the "Convention on the Rights of the Child," which the occupying state ratified in 1991. This convention ensured children's rights to freedom and childhood away from all these violations. Among them are:</p> <p> </p> <p>- 9 female martyrs.</p> <p>- 32 martyrs from the prisoners movement.</p> <p>- 55 children under the age of 18.</p> <p>- 5 martyrs from the 1948 occupied territories.</p> <p>- 6 martyrs from Palestinian refugees in Lebanon.</p> <p> </p> <p>Since the start of the genocide against our people in Gaza, the occupation has escalated its policy of holding bodies. Since the war, the occupation has held 149 bodies, which constitutes more than half of the martyrs held since 2015. It is important to note that this figure does not include the bodies held from the Gaza Strip. The number of martyrs from Gaza held by the occupation is estimated to be in the hundreds, but there is no official statement from the occupation regarding the actual number of bodies from Gaza to this day.</p> <p> </p> <p>Key Data on the Crime of Holding Martyrs' Bodies (As a Systematic Historical Policy):</p> <p> </p> <p>The crime of holding martyrs' bodies, practiced by the Israeli occupation, is one of the prominent historical policies used as part of the crime of collective punishment against martyrs and their families, and as a mechanism of control and punishment of Palestinians. This issue has passed through several stages and has been closely linked to the escalating level of resistance and confrontation against the Israeli occupation system. Since the occupation of Palestine in 1948, the occupation has used this policy, continuing its implementation until 2008, and resumed it with a decision by the Israeli cabinet in 2015, at the beginning of the popular uprising. The occupation did not stop at holding the bodies but also imposed certain conditions when returning the bodies. It also applied a classification policy as part of the conditions imposed on families, particularly affecting martyrs with Jerusalemite identities, by imposing harsh and unjust restrictions in the context of the occupation's desire for revenge against the living and the martyrs.</p> <p> </p> <p>This issue underwent legal transformations since 2017. On December 14, 2017, the so-called Israeli Supreme Court decided to postpone its ruling invalidating the holding of martyrs' bodies to allow the Israeli authorities to legislate clear and explicit provisions authorizing the military and police leadership to hold martyrs' bodies. In September 2019, the Supreme Court issued a decision allowing the military commander to hold the martyrs' bodies and bury them temporarily for use as bargaining chips in negotiations. It also imposed broad conditions authorizing the previously mentioned authorities to issue orders to hold the bodies of some martyrs. In reality, the vast majority of the martyrs whose bodies are held do not meet the conditions imposed by the court, making this issue a new phase in the role played by the so-called Supreme Court in consolidating the crime of holding martyrs' bodies. This was followed by efforts by the Israeli Knesset to legislate a law authorizing the occupation police to hold martyrs' bodies, and later an amendment was made to the "Anti-Terrorism Law."</p> <p> </p> <p>Holding Martyrs' Bodies Since the Start of the Genocide:</p> <p> </p> <p>The ongoing genocide against our people in Gaza has brought about transformations on all levels, with the enormous crimes committed by the Israeli occupation. The issue of martyrs' bodies is one of the most prominent of these issues, with the number of bodies held by the occupation increasing. Since thestart of the war, the number of bodies held reached 149, which constitutes more than half of the martyrs held since 2015. This number does not include the martyrs from Gaza whose bodies are held, estimated to be in the hundreds. </p> <p> </p> <p>To this day, there is no official statement from the occupation regarding the actual number of bodies held from Gaza, in addition to the fact that the occupation employs a policy of concealing identities as another face of the systematic crime of enforced disappearance, instead assigning numbers to the bodies. The only information that has emerged regarding the bodies of martyrs from Gaza held by the occupation was in July 2024, when the Hebrew newspaper Haaretz revealed in an article that the Israeli occupation holds about 1,500 bodies of Palestinians whose identities are unknown, stored in refrigerated containers inside the military base known as Sde Teman, and they were classified by numbers rather than names. The newspaper mentioned that the condition of the bodies had reached a certain stage of decomposition, with some missing limbs and others without identifiable features. </p> <p> </p> <p>During the war, the occupation handed over the bodies of 428 unidentified martyrs in several batches, and they were buried in mass graves in Khan Younis and Rafah in the southern Gaza Strip. The scene of the occupation handing over the bodies of martyrs in blue bags was one of the most striking images, reflecting the level of savagery of the occupation and its disdain for human dignity as one of the aspects of the ongoing genocide for more than ten continuous months.</p> <p> </p> <p>Holding Martyrs' Bodies in Violation of International Conventions and Charters:</p> <p> </p> <p>This policy contradicts all international customs and charters that stipulate respect for the victims and the return of their bodies. The relevant rules of international humanitarian law concerning the treatment of the dead, their remains, and their graves include Rule 112 on searching for and collecting the dead, Rule 113 on protecting the dead from pillage and mutilation, Rule 114 on the return of the dead's remains and their personal belongings, Rule 115 on the disposal of the dead, and Rule 116 on identifying the dead.</p> <p> </p> <p>The First Geneva Convention of 1949, in Article 17, emphasizes the importance of decent and respectful burial, stating that the parties to the conflict must "ensure the dead are honorably interred, if possible according to the rites of the religion to which they belonged, that their graves are respected, grouped according to nationality, and properly maintained and marked so that they can always be found."</p> <p> </p> <p>In addition to Article 17 of the First Geneva Convention, Article 120 of the Third Geneva Convention, Article 130 of the Fourth Geneva Convention, and Article 34 of the Additional Protocol require facilitating the return of the bodies and remains of the dead.</p> <p> </p> <p>The National Campaign for the Retrieval of Martyrs' Bodies and Palestinian human rights organizations renew their constant demand for the international legal system to resume its necessary role in stopping the genocide and to stand up for humanity by addressing the terrifying state of paralysis that surrounds its role in the ongoing Palestinian tragedy that has persisted for decades and to exert pressure to free the bodies of our martyrs.</p> <p> </p> <p>Release the bodies of the martyred prisoners, release the martyred prisoners.</p> <p>We have names...
