Palestinian Authority officer Abu-Mustafee was executed by firing squad Friday, February 25th in the morning at 2:00 am after being found guilty of molesting a 6-year old child, Abu-Shamaleh, from the Khan Yunis refugee camp. The death penalty had been imposed by a military court on Thursday 25 February, 1999 at 11:30pm.

Following the widespread Palestinian public anger that came in response to the crime committed by Abu-Mustafee, Addameer Institution for the Care and Protection of Prisoners and Human Rights believes it is essential to stress the following:
- We believe that the death penalty is not a deterrent. The PA is called upon to investigate the measures and procedures necessary to prevent the repetition of such crimes.
- We support the complete implementation of the rule of law but this will not take place at the expense of a fair trial which enables the offender to defend himself and gives him the chance to appeal. A trial and execution which are only separated by the interval of few hours does not fit the requirements of a fair trial.
- We demand that the PA acts to prevent such crimes through seriously and efficiently enhancing the rule of law which upholds equal protection for all citizens.
